The www.betapharmacy.ca web site (the “Web Site”) is owned and operated by Beta Pharmacy. In this Privacy Policy, “Beta Pharmacy,” “we,” “us,” and “our” refer to Beta Pharmacy.
This Privacy Policy explains our privacy practices for customer information we collect through our Web Site, www.betapharmacy.ca. Personal information and personal health information collected or provided when customers visit other websites are governed by the privacy policy posted on those websites.

Beta Pharmacy is committed to protecting the privacy of our customers. We have taken, and will continue to take, measures designed to protect the privacy of personal information and personal health information held by us.

Children: We encourage parents to take an active interest in their children’s use of the Internet. We do not intend to collect information from children who are under 18 years of age. If you are under 18, please do not provide information on our Web Site.
2. What Is Personal Information?
In general terms, personal information means any information about an identifiable individual, such as your name, postal code, e-mail address, telephone number, credit card number, demographic information, and purchasing history. A special category of personal information is “personal health information,” described in Section 3 below.

3. What Is Personal Health Information?
Personal health information means information relating to your physical or mental health collected or generated in the course of providing you with health services, and prescription profiles for fulfilment of pharmacy orders. Examples include medical history, drug prescription information, or health insurance information required to provide pharmacy-related services, as well as information you provide to Beta Pharmacy personnel when receiving counselling or advice, or when contacting us with a comment, question, or complaint.
4. When We Collect Personal Information
We collect personal information: (1) when you contact us; (2) when you use our Web Site; (3) when you participate in any of our programs; and (4) when you place orders or make purchases on our Web Site. We may automatically collect information when you visit our Web Site, such as your device and network information, operating system, referring site, and the time, date, and duration of your visit and purchases, including through cookies and similar technologies (see Section 12).
5. How We Use Personal Information
We hold and use personal information pertaining to you to operate and grow our business, process your requests, and understand your needs so we can serve you and market to you effectively. We may use personal information for purposes including, without limitation:
- Notifying you of recalls or safety issues;
- Managing the provision of goods and services to you, including determining credit status and for fraud detection and identification purposes;

6. When We Share Personal Information
We may share personal information with our related companies, franchisees, and licensed pharmacy locations operating under the Beta Pharmacy name for the purposes listed above. Personal information may also be disclosed to unaffiliated third parties in connection with the sale, financing, assignment, merger, or other transfer of all or part of our business or assets, in which case we will require such third parties to adhere to the terms of this Privacy Policy or a substantially similar policy.
We engage unaffiliated third parties and their affiliates, agents, and subcontractors (“Service Providers”) to perform technological, marketing, analytics, and administrative services on our behalf, including credit card processing, cloud hosting, data storage, e-mail, and Web Site administration. Service Providers receive only the personal information reasonably necessary to perform their services and are contractually required to keep it confidential and secure and to use it only for the purposes we authorize.

We will also disclose personal information when required or authorized by law, regulation, search warrant, subpoena, or court order, or to protect the rights, property, or personal safety of Beta Pharmacy, its customers, employees, or the public. Except as set out in this Policy, we do not sell, rent, or share personal information or personal health information we hold, or make our membership list available to others for a fee, without your consent.
Beta Pharmacy is not liable for any damages arising from unauthorized access to, or interception, alteration, or loss of, data transmitted over the Internet or held by a Service Provider, except to the extent directly caused by Beta Pharmacy’s gross negligence or wilful misconduct.
7. When We Collect, Use, and Share Personal Health Information
In the course of providing pharmacy-related services and programs, we collect, generate, and use personal health information to provide the health services you request, to obtain or process payment for those services, and for internal management purposes including planning, resource allocation, policy development, quality improvement, monitoring, audit, evaluation, and reporting. Your personal health information may be shared between Beta Pharmacy’s related and licensed locations for these purposes.
Beta Pharmacy and its Service Providers will not use or disclose your personal health information without your consent except in connection with: (1) processing or obtaining payment for government-funded health services; (2) processing or obtaining payment from your health insurance provider; (3) providing Beta Pharmacy with technological or administrative services as described in Section 6; or (4) the sale, assignment, or other transfer of our business, in which case we will require such third parties to adhere to the terms of this Privacy Policy. We will also disclose personal health information where required or authorized by law, or to protect the rights, property, or personal safety of Beta Pharmacy, its customers, employees, or the public, and as required to maintain standing with professional pharmacy bodies.
8. How Long We Hold Personal Information and Personal Health Information
Personal information and personal health information is retained for so long as necessary for the purposes set out above, or as otherwise reasonably necessary to protect Beta Pharmacy’s legitimate business, operational, and legal interests, including defending against claims. When no longer required, we will take reasonable steps to destroy, erase, or de-identify the information, subject to longer retention where required by law. We may restrict access to information retained for legal-compliance purposes.

No system is completely secure, and Beta Pharmacy is not responsible or liable for damages resulting from a security incident except to the extent directly caused by our gross negligence or wilful misconduct. 11. Accessing Personal Information and Personal Health Information
Customers are entitled to access the personal information and personal health information we hold about them, but not about a spouse or others, except where required or permitted by law (for example, a parent, guardian, or substitute decision maker). You may request access by visiting any Beta Pharmacy counter at 104A-3701 Hastings St. Burnaby, BC, Canada V5C 2H6, or by calling 1.877.968.3595, Monday to Friday 9:00 am to 5:30 pm, Sunday 12 noon to 5 pm EST (hours subject to change).
We will generally respond within thirty (30) days, or such further period as permitted by law where circumstances require. We may charge a reasonable fee, to the extent permitted by law, for transcription, reproduction, or transmission of the information requested, and you will be advised of any such charges in advance. In limited circumstances, including privileged communications or pending legal proceedings, we may not be able to provide access, and we will provide written reasons for declining a request.
Personal information and personal health information you disclose by e-mail may be stored in Canada, the United States, or elsewhere, and may be subject to disclosure under the laws of the jurisdiction where it is held. 12. On-line Privacy Practices
Collection: We collect personal information and personal health information on-line as described in Sections 4 and 7. We also collect information through cookies, web beacons, pixels, and similar tracking technologies, including your IP address, browser type, referring site, and path through the Web Site, which we use to operate, secure, personalize, and improve the Web Site and to support advertising and analytics, including through third-party advertising and analytics networks. Cookies are optional for browsing but are required to register, log in, purchase, or add items to your cart. By using our Web Site, you consent to our use of cookies and similar technologies as described in this Policy; you may adjust your browser settings to manage cookies.

13. Limitation of Liability and Indemnification
To the maximum extent permitted by applicable law, Beta Pharmacy’s aggregate liability arising out of or related to this Privacy Policy, the Web Site, or the collection, use, or disclosure of personal information or personal health information, shall not exceed the amount you paid to Beta Pharmacy for the goods or services giving rise to the claim in the twelve (12) months preceding the event. Beta Pharmacy shall not be liable for any indirect, incidental, special, consequential, or punitive damages. You agree to indemnify and hold Beta Pharmacy, its owners, officers, employees, and agents harmless from any claim or demand, including reasonable legal fees, arising from your misuse of the Web Site, your breach of this Policy, or your violation of any law or third-party right.
14. Governing Law and Dispute Resolution
This Privacy Policy is governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising out of or relating to this Privacy Policy that cannot be resolved informally shall first be submitted to Beta Pharmacy’s Privacy Officer under Section 15 below, and, failing resolution, may be referred to binding arbitration on an individual (non-class) basis in Burnaby, British Columbia, to the extent permitted by applicable law.
